These Terms of Use ("Terms") govern your purchase and use of digital products, including but not limited to The Family Photographer Client Experience Kit, The Wedding Photographer Client Experience Kit, The Newborn Photographer Client Experience Kit,  and any related templates, guides, or resources (collectively, the "Products"), offered by Stephanie Ponce Creative ("we," "us," or "our"). By purchasing or using our Products, you agree to these Terms.


1. License Grant
Upon purchase, you are granted a limited, non-exclusive, non-transferable license to use the Products for your own individual business. This means:

- You may customize and use the templates, emails, and guides included in the Products within your own client communications.
- You may **not** resell, redistribute, share, republish, or repackage the Products — in whole or in part — as your own product, template, or offering, whether for free or for payment.
- You may **not** share your copy of the Products with other businesses or individuals outside your own company.
- This license is for a single business or individual only. Group licenses or agency use require separate written permission.

2. Intellectual Property
All content within the Products — including written templates, copy, design, structure, and branding — is the intellectual property of Stephanie Ponce Creative and is protected by copyright law. Purchasing the Products does not transfer ownership of this intellectual property to you.

3. No Professional Advice
The Products are general business templates and educational resources based on the creator's own experience. They do not constitute legal, financial, tax, or professional business advice. You are responsible for ensuring that any template, policy, or communication you use complies with your own local laws, contractual obligations, and professional standards before using it with your own clients.

4. No Guarantee of Results
We do not guarantee any specific outcome from using the Products, including but not limited to increased bookings, revenue, client retention, reviews, or referrals. Results depend on numerous factors outside our control, including your market, business practices, and how you implement the material.

5. Limitation of Liability
To the fullest extent permitted by law, Stephanie Ponce Creative and its owners, employees, and affiliates are not liable for any direct, indirect, incidental, or consequential damages, disputes, losses, or claims arising from your use of the Products — including but not limited to client disputes, contractual issues, missed permits or location requirements, or business decisions made using this material.

6. Third-Party Tools & Referral Links
The Products may reference or link to third-party platforms, including but not limited to HoneyBook, Dubsado, 17hats, Pixieset, Studio Ninja, and Sprout Studio. We are not responsible for the features, pricing, availability, or terms of any third-party platform. Some links included in our Products may be referral or affiliate links, meaning we may receive compensation if you sign up through them, at no additional cost to you. This will always be disclosed where it occurs.

7. Refunds
Due to the instant-access, digital nature of this product, all sales are final. Because the complete kit is available for download immediately upon purchase, we are unable to offer refunds once a purchase is complete.

8. Changes to These Terms
We may update these Terms from time to time. Continued use of the Products after changes are posted constitutes acceptance of the revised Terms.

9. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
